General Terms and Conditions for Delivery Services

When ordering Bersatu Express services, you as the Sender, are agreeing on your behalf and on behalf of the Recipient and anyone else with an interest in the delivery service (each a “Party”, and collectively the “Parties”) that these Terms and Conditions shall apply to the delivery service.

1. General Terms

i. Any such purchasing terms and conditions shall apply only if We expressly confirm the same in writing. Acceptance of your delivered goods shall be deemed acknowledgement of our terms and conditions. We do not ship for you any combustible materials, items that contain poisonous fumes and any such items that is deemed dangerous and illegal in Malaysia. You will be liable if you fail, neglect or refused to inform us on the nature and condition of your items for shipment.

ii. You acknowledge that the internet is not a secure medium and information submitted for the Services hosted on Our Website may be accessed by third parties. Bersatu Express accepts no liability whatsoever in this circumstance.

iii. Any form of documentation provided by Us must not be copied or made available to any third party or use for any other purpose other than the intended and agreed purpose as indicated in Our Website.

2. Goods Limitation

i. The Company will NOT ACCEPT the following items for courier: CASH (in any currency, CASH CHEQUES, REDEEMABLE CASH VOUCHERS, NEGOTIABLE INSTRUMENT (share certificates, bonds, etc.) , JEWELLERY/PRECIOUS METALS AND STONES, PERSONAL DOCUMENTS (identity cards, passports, certificates, etc) , WORKS OF ART, FIREARMS/EXPLOSIVES, ALL COMBUSTIBLE/INFLAMMABLE PRODUCTS (e.g. paint, turpentine, spirit, etc) , LIQUOR, TABACCO, PERISHABLE FOODSTUFF, ANY OTHER DANGEROUS OR HAZARDOUS ITEMS, HANDPHONES and any goods or materials that are prohibited by law, rule or regulation of any country.

ii. Mover assumes no responsibility for insuring or otherwise providing for clearance of lorry through or inspection by premise’s management. Mover is not responsible for the application for entry permit into pickup or delivery premise if the management rule and regulation require entry pass or permit to be applied beforehand. Mover or party in possession shall not be liable for loss, damage, deterioration of the goods or delay in delivery due to the process for management clearance or inspection.

3. Pickup and Delivery

Pick-ups and deliveries shall be made between 0800 and 1800 hrs local time unless special arrangement already been made and agreed upon for timing beyond previously mentioned time. Appointments shall be made at no charge. Mover shall not be liable for late deliveries or unkept appointments due to circumstances beyond mover’s control such as but not limited to weather and traffic conditions, store loading and wait times, customer special requests, and other unexpected barriers to loading or unloading.

4. Cancellation of Booking

Any cancellation shall be made BEFORE twenty-four (24) hours of scheduled pick-up by informing Bersatu Express. Customer Service or the assigned mover by call, Whatsapp or SMS.

If a service is booked and then cancelled within twenty-four (24) hours of scheduled pick-up, customer shall pay 50% from the booking total price or RM200 cancellation charge (whichever is lower). Cancellation fee may also applicable but not limited to the following circumstances:

If the mover already arrived discovers, through communication with the customer, that the customer’s items are not eligible for the Services due to not limited to, items under the “GOODS LIMITATIONS” list and/or incorrect information provided by the customer that make the moving process unable to proceed.

5. Additional License, Permits and Deposit Fees

Whenever any additional license or permits are required, such as but not limited to, warehouse entrance pass, foreign commerce, customs fee and premise’s management deposit fee, the charge shall be arranged and provided by the customer and not the mover.
If and/or when mover(s) are refused entry due to improper documentation, the fee of 50% from the booking total price or RM200 will be assessed accordingly. Additional fees for driver detention, and/or storage will also be applicable.

6. Delivery Service

  1. Loading Service:
    -Drivers will lift the items from the lorry to the ground next to the lorry or vice versa only. Drivers are not required to lift the items to and fro the premise with this service.
  2. Door-to-Door Service:
    -Drivers will provide moving services which include loading and unloading of items to and fro the premise. the charges for Door-to-Door Services vary between van and lorry. Surcharge applies with additional helpers.

7. Long Push

Long push will apply when our movers have to push your belongings from outside of your house/building to your entrance. The extra fee for long push will be RM50 per manpower for distance between vehicle and entrance of between 50-150 meters.

8. Reconsignment or Diversion

A request for diversion of transport will be subject to the following definitions, conditions and charges:
  1. Request for diversion must be informed to Bersatu Express. Customer Service department in writing (e-mail, Whatsapp or SMS) or phone call.
  2. Diversion prior to movement of a shipment shall bear the rate that would otherwise have applied if the shipment was originally scheduled for movement to the final destination.
  3. Diversion en route shall be determined on the basis of the distance from origin to final destination via diversion point.
  4. If the transport is returned to the origin point, the rate to be applied will be the applicable rate to the most distant point actually traveled in

9. Passing of Risk

When the your goods are transported or moved for the purpose of transportation, any risk (including accidental loss, destruction or deterioration)(“Risk”)shall pass to you as soon as we have delivered the goods to the assigned mover. As part of our value-added services, We will assist in ensuring the highest level of care is administered while handling and transporting your goods but we cannot accept any liability arising therefrom.

10. Indemnity and Liability

You undertake the Services at your own risk and agrees to indemnify Bersatu Express and its employees against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors fees) and any claim arising from your own actions in any way in connection with the Service, or a breach of your obligation as set forth in these Terms and Conditions.

Bersatu Express is not liable in any way of any costs, expenses, damages,, liability or injury arising out of or in any way connected with the Services, or a breach of your obligations us set fourth in these Terms and conditions.

The liability of the Company for any loss or damage to the Shipment howsoever arising and notwithstanding that the cause of the loss be unexplained shall be limited to the lesser of:

(1)  Shall not exceed RM200.00 or parcel value or whichever is lower; or

(2)  Not liable for any damaged/lost/undelivered Parcels arising out of circumstances beyond its control. This includes:

i.         the Sender violating any applicable laws and/or the Parcel being confiscated by any governmental or regulatory authorities;

ii.       hijacking, theft, or robbery of the Parcel (or any part thereof) or the consignment which the Parcel was a part of;

iii.     any “force majeure” events, such as natural disasters, explosions, wars, riots, strikes or forms of civil unrest, outbreaks of diseases, traffic obstructions, or mechanical breakdown;

iv.      inaccurate or false information provided by the Sender in connection with the Parcel (e.g. nature of Parcel, origin of Parcel, Recipient’s address, etc.).

Any claims brought against the Company with respect to damaged or delayed consignments shall be made in writing within 48 hours. For lost consignments, notification shall be made within 21 days from the date the documents or goods were due to arrive at their destination, failing which the Company shall not be held responsible for any loss or damage arising howsoever.

11. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. The Parties agree to submit any disputes to the non-exclusive jurisdiction of the courts of Malaysia.

12. Pickup and Delivery

We reserves the right to update these Terms and Conditions at any time and any changes may be made without notice to you. We recommend you to read this Terms and Conditions periodically.

By continuing to access or use Our Services after those revisions or changes become effective, you agree to be bound by the revised terms. If you do not agree to the new Terms and Conditions, please stop using the Website and/or Our Services.
